Approve Increase to Sheriff's Office Fees

Background:

This item was reviewed by the Administration Committee on 11/19/2019. The Sheriff's Office has not raised any of its fees since 2012; these changes are needed to more accurately compensate for what the services cost the county to provide. Attached is a comparison to show what costs are being charged along with the resolution for signature upon approval.

County Board Action Requested:

Approved new fees as presented by Sheriff Torgerson and signed supporting resolution as follows.

Resolution No. 19-255

WHEREAS, the Olmsted County Board of Commissioners shall set the fees to be charged by the Sheriff pursuant to MN Statute 357.09, subdivision 8; and,

WHEREAS, the Olmsted County Board of Commissioners shall set the fees to be charged, with the advice and consultation of the Sheriff, and,

WHEREAS, the Sheriff has advised and recommended the fees to be charged, pursuant to MN Statute 357.09, subdivision 8,

THEREFORE, BE IT RESOLVED, that the Olmsted County Board of Commissioners set the following fees to be charged by the Sheriff, pursuant to the provision of MN Statutes 357.09. 387.20, 641.12 and 624.714;

Olmsted Sheriff Service Fees

All Sheriff’s Office fees for Civil Process require prepayment. For any services not specified herein, the Sheriff shall be entitled to the same fees as for similar duties.

Service of legal documents regarding a court action Multiple services at the same address regarding the same court action - $100.00 per party for the first two parties and then $10.00 for each additional party. Service is not guaranteed, a diligent search and a minimum of three (3) attempts for service will be made prior to returning any documents as not found. $100.00 / Service (per individual)
Administrative fee for processing of civil papers that are subsequently canceled by client prior to service attempts $55.00
Administrative office work required or requested on behalf of clients $100.00 / Hour

Conducting Sheriff’s Sales (Mortgage Foreclosure Sales, Execution Sales, Lien sales) $100.00 / Sale
Deputy standby for enforcement of a Writ of Recovery of Premises & Order to Vacate or any other standby for retrieval or exchange of personal property (2-hour maximum) $85.00 / hour per Deputy
Deputy standby for any other standby for retrieval or exchange of personal property (4-hour minimum) $75.00 / hour per Deputy
Posting three Notices of Sale - Foreclosure by Action $150.00 / Service
Preparation of publication of Notice of Sale - Foreclosure by Action $250.00
Redemption request on foreclosed mortgage and issuance of Certificate of Redemption $250.00 (non-refundable)
Recorded Notice of Intent to Redeem and supporting documents filed with the Sheriff’s Office $100.00 (non-refundable)
Any documents following a redemption received and maintained for public inspection by the Sheriff’s Office (MSA 580.25) $20.00
Seizure and recovery of property per Replevin, Order for Seizure, Writ of Attachment, Writ of Execution or any other such Court Order $100.00 / Hour per Deputy
Writ of Execution - Service of a bank levy, wage levy or personal demand $100.00 / Service
Writ of Execution - Commission for collections made on judgments 5%
